Terms and Cancellation

Scope
These terms apply to private tours and experiences offered under the Exclusive Explorations brand, operated by Free Walking Tour Salzburg e.U., Ignaz-Härtl-Straße 8, 5020 Salzburg (referred to below as we).
How a booking comes about
An enquiry through this website is non-binding and free. The sequence: once we have agreed the day, we send you a payment link. Completing the payment step authorizes your card without charging it; your booking is then reserved.
The contract comes about with our final confirmation. Only at that moment is your card charged. If we cannot confirm, the authorization is released and you pay nothing. If you cancel before our final confirmation, the authorization is likewise released at no cost; the cancellation terms below apply from final confirmation onward.
Prices and payment
All prices are per party, not per person: every tour is private, so it is only ever you and the people you booked for. The price is stated on the tour page and shown again before payment. Payment is by card through a secure payment link provided by our payment processor Stripe.
Under § 6(1)(27) of the Austrian VAT Act, no VAT is charged (small business exemption).
Cancellation
If you cancel up to 7 days before the tour, we retain 10% of the tour price. If you cancel less than 7 days before the tour starts, we retain the full tour price.
Refunds are processed within 7 days. To cancel, an informal email to[email protected]is enough.
Right of withdrawal
For leisure services with a fixed date there is no statutory 14-day right of withdrawal under § 18(1)(10) of the Austrian Distance Selling Act (FAGG). The cancellation terms above apply instead, and we state them deliberately before you pay.
Weather and force majeure
Salzburg rains. In bad weather we change the route, not the day: your guide has a plan for indoors as well as out. If we have to cancel a tour for reasons within our control, or due to force majeure, we offer you a free rebooking or a full refund.
Liability
We are liable for intent and gross negligence, and without limitation for personal injury, as provided by law. We are not liable for slight negligence, except in the case of personal injury. Our tours take place in public space; please watch for pavements, steps and viewpoints. Your guide points out anything unusual; responsibility for your own footing stays with you.
Governing law
Austrian law applies, excluding its conflict-of-law rules. This choice of law does not affect the mandatory consumer protections of the country where you habitually reside. For consumers, the statutory places of jurisdiction apply; otherwise the place of jurisdiction is Salzburg.
